hello! to ensure a happy and secure experience for both of us, i’ve outlined my commission policies below. please read through them carefully before paying. by sending payment, you acknowledge and agree to these terms.

── .✦ I. payment & fulfillment ✦. ──
✦ invoicing & orders: for vgen, fiverr, and artistree, the platform-generated proposal/invoice will be used. for direct orders (paypal/gcash/others), an invoice will be sent after confirming requirements. for ko-fi, payment is made at the time of request; i reserve the right to refund and decline if requirements cannot be met.✦ payment: 100% upfront payment is required before work begins. work will not be added to the active queue until payment is confirmed.✦ countdown: your turnaround time (TAT) officially starts only after payment is received, all requirements are confirmed, and your assigned slot in the queue becomes active. i will notify you when your piece is officially "in-progress."✦ chargebacks: by commissioning me, you acknowledge that any bad-faith chargebacks are a breach of contract. i reserve the right to share transaction logs, chat history, and evidence of the dispute with payment processors, vgen support, and community blacklists to protect my business.

note: make sure your requirements are complete before submitting! for skeb-style commissions, there is no further communication or revisions after the order is placed.
✦ timeframe: the average turnaround time (tat) refers to active production time per commission. your total wait time depends on your position in the queue; i will provide an estimated start date once requirements are reviewed. (example: if you are slot #3, your tat begins only after slots #1 and #2 are completed). if a listing states "no queue," work begins immediately after payment and confirmed requirements.✦ communication & the 48hr rule: i work best when we keep the momentum going! if i don’t hear back regarding feedback or info within 48 hours, your project will be placed on hold and moved to the end of my current queue. once you return, i will fit you back into my schedule as soon as my current task is finished.✦ stalled projects [universal]: if an order is stalled for more than 25% of the total timeline (e.g., 2 days of silence on a 7-day TAT) due to a lack of response, i reserve the right to officially pause the project and move the delivery date. i am not responsible for "late" status caused by client delays.{ please read more on section III confirmation & closure for refund process.}

── .✦ II. communication & revisions ✦. ──
✦ skeb-style: for these specific listings, no drafts, previews, or revisions are provided. communication pauses after payment confirmation until final delivery. by ordering, you agree to accept the final artwork as-is.✦ standard orders: requested changes must be stated clearly during the initial requirement phase. free revisions (small tweaks, not a full redraft/restart) are only available during the specific stages mentioned in your listing (e.g., sketch phase). once the final file is delivered, the commission is considered fulfilled.✦ wips: for non-skeb requests, i provide watermarked WIPs (work-in-progress updates). frequency depends on complexity. high-resolution, unwatermarked files are provided only upon final delivery.✦ message integrity: for communication on any platform (discord, artistree, sns, ko-fi, etc.), you agree not to delete or unsend messages. these logs serve as our permanent record; tampering with or deleting this history voids your usage license and will be treated as a violation of our agreement.✦ emergency & platform contact: please use sns for emergencies only. all other business discussions must stay on the ordering platform or email. note: ko-fi, direct, and gforms orders are discussed exclusively via email.✦ fiverr & vgen platform rules: per platform terms, all communication and final delivery for fiverr and vgen orders must stay within their respective workrooms. external email delivery and sns contact are not available for these orders to ensure platform protection for both parties.

── .✦ III. confirmation & closure ✦. ──
✦ the 48-hour check-in: once i deliver your final files, you have 48 hours to look everything over. please let me know right away if there are any technical hiccups (broken links, access errors, or resolution issues). i’m happy to fix those for you!✦ automatic closure: if i don’t hear from you within 48 hours of delivery, the commission is considered successfully completed and closed. once this window passes, the service is finalized, and i cannot provide further edits, file adjustments, or refunds.✦ a note on fiverr: while fiverr automatically marks orders as "complete" after 3 days, please stick to the 48-hour rule above for any technical fixes.✦ refund policy [excluding fiverr]: after work begins: because these are custom digital services, i cannot offer refunds once i have started working and sent a WIP update.
>> cancellation by client: if you cancel before work has begun, i will refund the net amount received (this excludes non-refundable fees kept by the payment processor/platform).
>> cancellation by artist: if i must cancel for personal reasons, i will issue a 100% full refund including fees. i retain all rights to any unfinished work; it may not be used, posted, or finished by any other party.
50% refund - if only the sketch is finished.
30% refund - if lineart or base phases are finished.
10% refund - if multiple tweaks or revisions were already processed.
no refund - once the project reaches the final rendering stage.
✦ abandonment [universal]: a project is considered "abandoned" if the client is unresponsive for 14 days (5 days for <30days TAT, 48hrs for <7days TAT). A 50% kill fee applies.✦ future service (blacklisting): unfortunately, abandoned orders result in a permanent loss of future services. i will not be able to accept new commissions from you moving forward unless a very reliable/emergency reason is provided and verified.✦ kill fee: because i have reserved a slot in my schedule and performed labor, a 50% kill fee applies to all abandoned projects. in these cases, the order will be closed and 50% of the payment will be retained as compensation for my time. the remaining 50% will be refunded to the client.✦ rights: no unfinished work, sketches, or WIPs will be delivered for abandoned projects. i retain full copyright and ownership of all progress made. no refunds are issued once the project reaches the final rendering stage. { please see refund policy above. }✦ fiverr exception: due to fiverr’s specific policies, abandoned orders may be mutually cancelled or extended indefinitely rather than processed as a "kill fee" to protect account standing.✦ status protection [vgen]: for stalled orders on vgen, i will issue a formal extension request through the workroom. this must be accepted to keep the order in good standing. per vgen's system, i cannot process a partial refund via the "cancel" button. for abandoned orders, i will contact vgen support to manually process the 50% kill fee and close the request.

── .✦ IV. usage & rights ✦. ──
✦ for you (personal use): this commission is for personal use only. i’d love to see it as your profile picture, banner, or a private print for your wall! however, you cannot re-sell the art, use it for merch, or use it for profit.✦ streaming & monetization: using the art as a streaming avatar (pngtuber/vtuber) or for monetized videos/thumbnails is considered commercial use and requires a specific license. please contact me to add this to your order!✦ hands off: please do not trace, edit, or change my artwork. cropping for a profile picture is totally fine, but please don't draw over the art or change the colors without asking me first.✦ no ai / blockchain: i put my heart and soul into my work. using my art for ai training, machine learning, or NFTs is strictly forbidden. doing so is a direct violation of my copyright and will result in a permanent blacklist.✦ artist rights: i retain the full copyright to the artwork. i reserve the right to display the piece in my portfolio, post it on my socials, or use it for self-promotion (unless a "private commission" add-on was purchased).✦ privacy: if you’re not ready for the world to see your commission, please make sure to grab the private commission add-on at checkout! otherwise, i may share the finished piece or "behind the scenes" clips online.✦ character rights: you must own the character or have the right to commission artwork of them (e.g., fanart, game avatars, or OCs). i am not responsible for any copyright issues regarding the characters you provide.✦ credit & watermarks: please credit me (@neirlhune) whenever you post the artwork publicly. when posting to social media, you must use the watermarked version provided; the unwatermarked version is for your private, personal use only.✦ shop items: if you’re buying a premade asset or a shop item, check out section V below. those have their own special rules!

the following terms apply to all pre-made digital goods sold via ko-fi, itch.io, vgen, and other platforms (more soon):✦ all sales are final: since digital files are delivered instantly, i cannot offer refunds, returns, or exchanges once the files have been accessed or downloaded. please double-check the listing details and your cart before purchasing!✦ single-user license: your purchase grants a license for one person (you). assets are non-transferable; please do not share, "group-buy," or redistribute these files.✦ streaming & content usage: you are welcome to use these assets for your streams (including monetized/affiliate channels), profile pictures, or videos. however, you cannot use these designs for physical merchandise (shirts, stickers, etc.) or large-scale commercial projects unless a separate commercial license is purchased.✦ edits & derivative works: feel free to recolor or tweak the assets to fit your brand! however, i retain the original copyright. you may not claim the edited work as your own or resell the modified files.✦ tech check: please ensure your software/hardware is compatible with the file formats listed (e.g., .png, .psd, .procreate) before buying. while i will replace any corrupted files, i cannot provide technical troubleshooting for third-party software.✦ no ai / blockchain: as with my custom work, pre-made assets may not be used for AI training, machine learning, or NFT projects under any circumstances.
