by commissioning me, you acknowledge and agree to the terms and conditions outlined below. these policies are in place to ensure a clear, fair, and secure workflow for both the artist and the client. please read them carefully before proceeding with your payment.

── .✦ I. payment & fulfillment ✦. ──
✦ invoicing & orders: for direct (paypal/gcash), vgen, artistree, and fiverr orders, an invoice will be sent after confirming your requirements. for ko-fi, payment is made at the time of request; i reserve the right to refund and decline if requirements cannot be met.
✦ payment: 100% upfront payment is required before work begins.
✦ countdown: the project timeline officially starts only after both payment and all requirements (references/details) are confirmed.
✦ timeframe: the average fulfillment time depends on your selected commission type or listing. estimated deadlines will be discussed and confirmed after requirements are reviewed.
✦ digital delivery: for secure record-keeping and to prevent message loss, all final files are delivered exclusively via email. no physical items will be shipped.
✦ large files: for files exceeding email size limits, a google drive link will be provided. please download and save your files immediately. i do not provide permanent cloud storage and may delete the link after 30 days.
✦ invoice record: for direct payments, an invoice or receipt will be issued to your provided email address prior to the start of work.

── .✦ II. communication & revisions ✦. ──
✦ skeb-style (surprise me): for these listings, no drafts, previews, or revisions are provided. communication ceases after payment confirmation until final delivery. by ordering, you agree to accept the final artwork as-is.
✦ standard orders: (if applicable) any requested changes must be stated clearly during the initial requirement phase. once the final file is delivered, the order is considered fulfilled.
✦ wips: for non-skeb requests, i am happy to provide WIPs (work-in-progress updates). the frequency of these updates will depend on the specific timeframe and complexity of the project as discussed during the requirement phase. all of these will be watermarked or signed. all WIPs will be watermarked or signed; high-resolution, unwatermarked (but signed) files are only provided upon final delivery.
✦ message integrity: for any communication outside of email (e.g., discord, fiverr, sns), you agree not to delete or unsend messages regarding the commission, both during and after the project. these logs serve as our permanent record of agreement; tampering with or deleting this history voids your usage license and may be treated as a violation of copyright.
✦ emergency contact: please use sns for emergencies only. business discussion must stay on the platform or email.
✦ fiverr orders: per fiverr’s terms of service, all communication and the final delivery must be conducted exclusively through the fiverr platform. email delivery and sns contact are not available for fiverr-based orders.

── .✦ III. confirmation & closure ✦. ──
✦ 48-hour window: you have 48 hours from the time of email delivery to report technical issues (e.g., file corruption, wrong resolution).
✦ link access: it is the client's responsibility to verify that the provided download link works within the 48-hour inspection window. if you encounter an "access denied" or "file too large" error, please report it immediately so i can provide a mirror link.
✦ automatic closure: silence after 48 hours constitutes a successful and closed transaction (the service is deemed accepted and finalized in full.) i will not entertain revision requests, refunds, or file adjustments once this window has passed.
✦ fiverr orders automatic completion: per fiverr's system, orders are automatically marked as "completed" 3 days after delivery.
✦ refund policy: as this is a custom digital service, refunds are not available once work has commenced. if i (the artist) must cancel the order for personal reasons, a full refund will be issued.

── .✦ IV. usage & rights ✦. ──
✦ personal use only: you are granted a license for personal use (profile pictures, personal banners, or private printing). commercial use, re-selling, or distribution for profit is strictly prohibited. this includes using the artwork as a livestreaming/video avatar or for monetized content (unless specifically commissioned for that purpose).
✦ prohibited acts: you may not trace, edit, or modify the artwork without my express permission.
✦ ai & blockchain: use of the artwork for ai training, machine learning, data scraping, or nfts is strictly prohibited and will be treated as a copyright violation.
✦ artist rights: i retain full copyright over the artwork, including the right to display it in my portfolio or on social media.
✦ privacy: if you wish for the commission to remain private (not posted online), please inform me before payment is made.
✦ for premade assets or shop items, please refer to section V for specific usage rules below.

── .✦ V. digital shop & assets ✦. ──
the following terms apply to all pre-made digital goods sold via ko-fi, itch.io, and other platforms (more soon):
✦ no refunds: due to the instant nature of digital goods, all sales are final. no refunds or exchanges once the download link has been accessed.
✦ usage license: your purchase grants a personal-use license for one person only. usage outside of personal scope is only permitted when explicitly stated in the listing. you may use assets as intended (e.g., stream overlays, premade pngtuber avatars, intro music), but you may not sell merchandise featuring the art or use them for other commercial projects without a separate agreement.
✦ sharing & redistribution: files are non-transferable. sharing, "group-buying," or redistributing files in discord servers or public folders is strictly prohibited.
✦ alterations: you may edit or recolor assets for personal use, but you may not claim the original or edited work as your own.
✦ technical: please ensure your software is compatible with the listed file formats before purchasing. i am not responsible for troubleshooting software-specific issues.
